According to the Constitution
One of the duties of the U.S. Senate under our Constitution is to review judicial nominations made by the President, including lifetime appointments to the Supreme Court. This week, I met with Elena Kagan as part of my work as a member of the Judiciary Committee, which will formally consider her qualifications to serve on the Supreme Court with a hearing starting June 28. The question is whether the candidate will be true to the Constitution and the laws as written, and apply the law rather than personal beliefs and preferences in deciding cases. Elena Kagan does not have experience or a record as a judge, so the Senate Judiciary Committee needs to conduct an in-depth review of her writings, speeches and other documents to try to assess her judicial philosophy and fitness to serve as a Supreme Court Justice.
