As part of his look at EpiPen costs to consumers and taxpayers, earlier this week, Sen. Chuck Grassley wrote to the Iowa attorney general, asking him to review whether Iowa taxpayers have overpaid for EpiPens under Medicaid.  It appears Minnesota taxpayers may have overpaid for EpiPens by more than $4 million in a single year because the product might have been misclassified under a rebate program.  Attorney General Tom Miller responded today, saying that he already has directed his staff to look at the EpiPen pricing and that he will keep Grassley “informed, particularly regarding the Medicaid reimbursement issue.”  Grassley made the following comment.

“I appreciate the response.  Whether Iowa taxpayers paid more than they should have for EpiPens under Medicaid is important to figure out.  Congress needs to know whether oversight of the Medicaid drug rebate program is failing within the federal government, with companies, or both, so we can make sure taxpayers aren’t being overcharged.  I will continue to look into these issues for the people of Iowa.”
